Nancy Ritchie-Noakes joined Brunswicks LLP after 20 years’ experience gained with big UK and international law firms, including secondments to Queen’s Counsel Inquiry and to a specialist marine insurer.
Nancy has handled matters for her clients in arbitral and other tribunals; in the High Court in England (mostly the Commercial and Admiralty Registry); in formal and informal mediations; and early neutral evaluations. The financial costs and business interruption caused by trials makes them a last resort. In some cases a hearing is unavoidable, and when this happens Nancy has a reputation for success in conducting multi- party trials and inquiries involving large numbers of both factual and expert witnesses, and extensive documentation. Her particular skills are in marshalling bespoke teams of clients, barristers and technical experts to tackle complex disputes.
Many of Nancy’s more recent cases have been charterparty disputes, a number of which have involved ship arrests in various jurisdictions, for the purpose of obtaining security for claims. In the leisure sector, she has acted for boat owners and retailers in sale of goods disputes and pursuant to the Recreational Craft Regulations.
Her other regulatory experience has included incidents investigated by the Marine Accident Investigation Bureau; carriage of dangerous goods by road and sea; control of pollution on land and at sea; planning inquiries. More recently Nancy has begun to develop her regulatory practice to embrace health and social care. Her work on planning and environmental matters has covered appeals and inquiries related to the construction of a toxic waste incinerator, the operation of a coal handling facility and compensation claims before the Lands Tribunal. Nancy has been involved in group litigation against a water authority, and has advised clients regarding environmental protection and control of pollution.
Since clients generally prefer to anticipate business difficulties and forestall them, Nancy has been instructed to draft trading terms, consultancy contracts, Service User Guides and specimen correspondence, notices etc to meet clients’ individual needs. Having seen so often the consequences of ignorance, insouciance and inappropriate economising, Nancy is well placed to advise clients on avoiding disputes that require legal intervention.
